Terms of Service for Digital Goods

1. General Provisions

This document constitutes a public offer from Digital Commerce OÜ (hereinafter "Seller") to any capable adult individual or legal entity (hereinafter "Buyer"). Acceptance of the offer occurs when the Buyer pays for the order, at which point the offer becomes a binding contract.

By accepting, the Buyer confirms they have reviewed these terms, reviewed the privacy policy and consent to data processing, and are 18 years of age or older (or have legal guardian consent).

2. Terms and Definitions

• Site — the internet resource at kodshop.cloud
• Digital Goods — activation codes, gift cards, game keys, eSIM profiles, or other digital products delivered electronically
• Order — the Buyer's request to purchase digital goods on the Site
• Moment of Performance — the moment digital goods are sent to the Buyer's email
• Activation — the Buyer's use of goods on a third-party platform (Issuer)
• Issuer — third parties (Apple, Google, Steam, PlayStation, Nintendo, Netflix, Spotify, etc.) that issue cards/codes
• Regional Restrictions — technical and legal usage conditions set by Issuers for specific countries/regions

3. Contract Subject Matter

The Seller delivers digital goods matching the Site descriptions; the Buyer pays accordingly. Descriptions are informational, based on issuer data. Issuers may change names, conditions, or activation requirements without notice to the Seller.

Regional restrictions are essential contract conditions. The Buyer confirms reviewing restrictions before payment and accepts responsibility for region selection.

Digital goods are exclusively for personal use. Bulk purchasing for resale is prohibited.

4. Order and Payment Process

The Buyer selects goods, provides an email address, and proceeds to payment. Prices are fixed at the time of payment.

Available payment methods include bank cards, cryptocurrency, e-wallets, and other licensed payment services. The Seller may change prices unilaterally; price changes do not apply to already-paid orders.

5. Digital Goods Delivery

Digital goods are delivered by sending unique codes to the Buyer's specified email address. Delivery is automatic after payment confirmation, typically within minutes, with a maximum 72-hour delivery window.

The Seller's obligation is fulfilled when the code is sent to the Buyer's email. The Buyer is responsible for providing a correct email address.

6. Returns and Claims

Digital goods of proper quality are non-returnable and non-exchangeable.

Returns are not possible if:

• The code has been activated on the issuer's platform
• The Buyer violated activation instructions or issuer conditions
• The Buyer purchased goods for a region that doesn't match their account

The Buyer may request a return or exchange if:

• The code won't activate when following instructions (defective goods)
• Goods don't match the Site description (denomination, region, type)
• Double charging occurred for one order
• Goods weren't delivered within 72 hours

Claims should be sent to support@support.kodshop.cloud with the order number, problem description, and activation error screenshots (if applicable). The claim review period is 10 days from receiving complete documentation. Refunds are issued via the original payment method within 10 days of approval.

7. Liability Limitations

The Seller is not liable for: activation failures due to Buyer error; issuer condition changes post-delivery; Buyer account blocks on issuer platforms; third-party access to goods due to Buyer negligence; temporary Site unavailability.

The Seller's maximum liability is limited to the order cost. The Seller is not a representative, agent, or affiliate of any issuer.

8. Intellectual Property

Trademarks (Apple, Google, Steam, PlayStation, Xbox, Nintendo, Netflix, Spotify, etc.) belong to their respective owners. The Seller does not claim third-party rights. Their use is strictly for product identification.

Site materials (text, design, code) are the Seller's property and protected by copyright law.

9. Force Majeure

Parties are relieved of liability for non-performance caused by force majeure, including natural disasters, military actions, government decisions, payment system failures, and issuer actions blocking or revoking goods.

10. Modifications

The Seller may modify these terms unilaterally. Changes take effect upon publication and do not apply to previously-paid orders. The current version is always available at kodshop.cloud/terms.

11. Contract Term

The contract becomes effective upon acceptance and remains active until full performance. The Buyer may discontinue Site use at any time.

12. Governing Law and Dispute Resolution

This contract is governed by the laws of the Republic of Estonia. Disputes are resolved through negotiation. Claims should be sent to support@support.kodshop.cloud with a 10-day response deadline. If unresolved, disputes go to court at the Seller's location.
